This website is owned and operated by L'Image en Provence, 28 ive Neuve, 13007 Marseille, France in its entirety, along with all associated rights. The consent of the owners is systematically required for any full or partial reproduction of the content. However, hypertext links to the site are authorised without specific consent being sought.

1. Acceptance of terms and conditions

By placing an order, you confirm you have read and fully accept the terms and conditions of sale shown here, which govern the contractual relationship between Galerie Pêcheur d'Images and its customers, both parties accepting them unreservedly. Said terms and conditions of sale prevail over all other terms and conditions appearing in any other document, unless an express exception is made in writing in advance.

2. Products

The photographs illustrating the products have no contractual value. L'Image en Provence cannot be held liable for any errors in such pictures

3. Orders

Automated order processing systems are considered valid proof of the type, content and date of an order. L'Image en Provence sends an order confirmation to the email address provided by the customer. The sale is not deemed final until such order confirmation. L'Image en ¨Provence reserves the right to cancel any customer order if there is an existing dispute with said customer relating to the payment of a prior order. The buyer accepts responsibility for the information provided when placing an order; if there is a mistake in the recipient’s details, the seller cannot be held liable for inability to deliver the product.

4. Preparation of orders and delivery times

Order preparation times are given as a guide: Reproductions, non-signed books, canvases: 1 to 2 business days. Images signed by the author on top quality paper and signed books: the time required depends on when the author is in our shop. If it exceeds 3 weeks, we will keep you informed by email.

For further information and for urgent orders, please contact us by email. The relevant delivery time is applied in addition to the preparation time. Order delivery times are given as a guide: For France: 48 hours by Coliposte parcel service. After an order has been confirmed, we undertake to make all the products ordered by the buyer available to our carrier within the times mentioned above. Said carrier is contractually committed, vis-a-vis L'Image en Provence, to deliver the order to the buyer’s address provided by us. Furthermore, for deliveries outside mainland France, the recipient agrees to pay all product import taxes, customs duties, value added tax and other taxes due in accordance with the applicable legislation in the destination country. All orders placed with L'Image en Provence are intended for the personal use of the customers or recipients concerned; no partial or total resale of said products is permitted. Orders shall be delivered by post via the tracked parcel service [colissimo suivi], or by carrier. Damages cannot be claimed for late deliveries. Deliveries to EU countries are made by post via the Europe tracked parcel service [colissimo suivi Europe]. If the items you receive are defective, you can return them as follows: send us an email detailing the nature of the defect or defects and we will immediately send you a Returns Slip to be attached to your parcel. In the event of the following force majeure events, we are released from our delivery obligation: war, riot, fire, strikes, accidents and interruptions in supplies. The recipient assumes responsibility for the products during transit. Always check your parcel on arrival and record any issues when signing the delivery note. You will then have a period of 48 hours to make any claims to the carrier for missing or damaged products. An order may be split into several deliveries according to available stocks. In this case, you will only pay for one delivery. If you want your products to be delivered to 2 different addresses, you must place 2 orders and pay the associated delivery charges.

5. Cancellation

You have 14 days (from receipt of the items ordered) to change your mind. If you want an exchange or refund, please return the item(s) as new in its (their) original packaging to the following address: L'Image en Provence, 28 Quai de Rive Neuve, 13007 Marseille, France. If you exercise your right to cancel, L'Image en Provence is required to refund the sums paid, at no charge, with the exception of return costs. Refunds are due within a maximum of 30 days.

6. Prices

Prices are expressed in Euros. The price indicated on the product page does not include delivery. The price indicated in the order confirmation is the final price, inclusive of taxes and including VAT for France and EU countries. This price includes the price of the products, handling, packaging and storage costs and delivery and preparation costs.

7. Payment

The price invoiced to the customer is the price indicated on the order confirmation sent by L'Image en Provence. The price due is payable on the date of the order. Payment can be made by cards bearing the CB symbol. With SPPLUS, Your card number is therefore transmitted to the bank’s servers and your payment is made directly to a bank in a secure environment without going through the shop’s server, which offers you even more protection since your numbers are only known by our banking partner, Banque Nationale de Paris. The order submitted by the customer will only be considered effective when the bank payment centres concerned have approved payment. If the payment is rejected, the order will be automatically cancelled and the customer notified by email. Furthermore, L'Image en Provence reserves the right to refuse any order when there is an existing dispute with the customer concerned.

8. Disputes

This contract is governed by French law. L'Image en Provence cannot be held liable for damages of any kind, either property damage, consequential loss or physical injury, that might result from incorrect operation or use of the products sold. The same applies for any modifications of manufacturers’ products. Our liability shall, in any event, be limited to the amount of the order and cannot be sought for simple errors or omissions that might have occurred despite all the care we have taken in the presentation of the products. In the event of difficulties in the application of this contract, the buyer has the option to seek an amicable solution with the help of a professional association of the relevant sector, a consumer association or any other advisor of his/her choice, prior to taking any legal action Note that seeking an amicable solution does not interrupt the “short period” mentioned with regard to the statutory warranty, or the period of the contractual warranty. It is stipulated that as a general rule and subject to the assessment of the Courts, the contractual warranty set out in this agreement is upheld on the assumption that the buyer has honoured his/her financial obligations to the seller. Claims or disputes are always given due attention, with the assumption that the person involved has acted in good faith in setting out the details of the complaint or dispute. In the event of a dispute, the customer shall contact the company first and foremost in order to find an amicable solution. Failing this, the Marseille commercial court is solely competent, regardless of the delivery address and mode of payment accepted.

9. Warranty

L'Image en Provence warrants that all products selected are manufactured, produced or printed in FRANCE. L'Image en Provence cannot in any circumstances be held liable for failure to comply with the applicable regulations and legislation in the destination country; the liability of l'Image en Provence is systematically limited to the value of the product in question, as of the date of sale, with no possible appeal against the brand or the company producing the product. In any event, the customer benefits from the statutory covenants and warranty for hidden defects (Art.1625 et seq of the French civil code). Provided that the buyer provides proof of the hidden defect, the seller is legally required to compensate for all the consequences (art.1641 et seq of the civil code); if the buyer applies to the courts, he/she must do so within a “short period” from the discovery of the hidden defect (art.1648 of the civil code). 10. Legal notices The provision of personal information collected for the purposes of distance selling is compulsory since this information is essential for processing and delivering orders, issuing invoices and for the application of warranties. Failure to provide such information renders the order invalid. In accordance with the French data protection act, the processing of personal information relating to customers has been declared to the Commission Nationale de l'Informatique et des Libertés (CNIL – French data protection commission). As per article 34 of the French data protection act of 6 January 1978, customers have a right to access, modify, correct and remove information held about them, which they can exercise with L'Image en Provence. Furthermore, L'Image en Provence undertakes not to share the details of its customers with a third party, whether for payment or not.
